What inspired you to focus your legal practice on protecting seniors?

It’s great to be here! You know, I’ve always been drawn to helping people who are vulnerable. Growing up, I saw firsthand how easily older adults can be taken advantage of. It just seemed natural to me to dedicate my career to ensuring their safety and well-being.

Can you walk us through the typical steps involved in an elder protection case?

Absolutely! Think of it like a roadmap with several key stops along the way:

  1. Initial Client Engagement: This is all about getting to know the client, understanding their situation, and making sure there are no conflicts of interest.
  2. Case Assessment: We identify the specific legal issues at play – is it financial abuse? Neglect? Something else? – and gather all necessary evidence.
  3. Protective Actions: This could involve obtaining restraining orders, freezing bank accounts, or even petitioning for guardianship. The goal is to stop the harm immediately.
  4. Legal Proceedings: We may file lawsuits against abusers, refer cases to law enforcement, or navigate probate court matters.
  5. Long-Term Planning: Once the immediate crisis is resolved, we help clients create estate plans, advance directives, and other safeguards for the future.
  6. Let’s delve a bit deeper into ‘Protective Actions’. What are some of the challenges you face in this stage?

    Ah, Protective Actions. This is often where things get really intense. Time is crucial; we need to act quickly to prevent further harm. Sometimes, family members might be resistant to intervention, believing everything is fine. Other times, the abuser is cunning and tries to hide their actions.

    I recall one case involving a woman whose son was systematically draining her bank account. She initially defended him, saying he was just “helping” her manage her finances. It took a lot of patience and gentle persuasion to convince her she was being exploited. Ultimately, we were able to freeze her assets and initiate legal action against her son.
