If someone passes away without a will, the court determines how their assets are distributed. In essence, probate ensures that a person’s final affairs are handled legally and fairly.

Let’s focus on one specific aspect of the probate process: asset distribution. Could you walk us through that step?
Absolutely. Once the court has issued Letters Testamentary or Administration, authorizing the executor or administrator to act on behalf of the estate, they begin marshaling all the deceased person’s assets. This involves creating a detailed inventory of everything from bank accounts and real estate to personal belongings. Accordingly, the executor or administrator must then appraise these assets to determine their market value. This information is documented in court filings called the Inventory and Appraisal (Forms DE-160/161).
After the appraisal, the focus shifts to paying valid creditor claims against the estate. This process ensures that outstanding debts are settled before any remaining assets are distributed to heirs or beneficiaries. It’s crucial to remember that creditors have a legal right to be paid from the estate. Consequently, failing to address creditor claims can lead to complications and potential legal issues down the line.

Steve, are there any common challenges you encounter during asset distribution?
There are certainly instances where asset distribution can become complex. I recall a case involving a family with multiple heirs who disagreed on the valuation of a piece of inherited artwork. Such situations underscore the importance of clear communication and potentially seeking professional mediation to resolve disputes amicably.
