Could you tell us a little bit about your practice and what types of legal services you offer?

Probate & Trusts

Steve Bliss: I’ve been practicing probate law in San Diego for over 20 years. My primary focus is helping clients navigate the complex world of estate planning, probate administration, and trust litigation. I believe that everyone, regardless of their financial situation, can benefit from having some form of estate plan in place. One of the most powerful tools for protecting assets and ensuring that your wishes are carried out after you’re gone is a trust.

Trusts offer numerous advantages over simply relying on a will. They allow for greater control over how your assets are distributed, they can help minimize estate taxes, and they provide privacy that a will does not.

Special Needs Trusts: Meeting Unique Needs

Today we’re going to focus on Special Needs Trusts (SNTs), which are particularly valuable for individuals with disabilities. Can you explain how these trusts work and why they’re so crucial?

Steve Explains Special Needs Trusts

Special Needs Trusts are designed to provide financial support for individuals with disabilities without jeopardizing their eligibility for government benefits like Supplemental Security Income (SSI) or Medi-Cal. This is incredibly important because these programs often have strict income and asset limitations.

There are two primary types of SNTs: first-party and third-party. A first-party SNT is funded with the beneficiary’s own assets, while a third-party SNT is established and funded by someone else, like a parent or guardian.

The trustee of an SNT manages the funds and uses them to pay for expenses that are not covered by government benefits, such as medical care, education, recreation, or assistive devices. Consequently, the beneficiary can maintain their quality of life without exceeding the income thresholds required for these vital programs.

I’ve seen firsthand how SNTs can make a world of difference for families dealing with disabilities. For instance, I once worked with a young woman who had cerebral palsy and relied on SSI for her living expenses. Her parents wanted to ensure she could continue receiving the care she needed while also having some financial flexibility. We established a third-party SNT that allowed them to contribute funds without affecting her eligibility for benefits.

Notwithstanding the complexities of trust law, it’s incredibly rewarding to help families plan for the future and provide peace of mind knowing their loved ones will be well cared for.

Challenges & Considerations

Have you encountered any challenges or unique situations when setting up SNTs?

Steve Bliss: Setting up an SNT requires careful planning and attention to detail. One common challenge is ensuring that the trust language aligns with the beneficiary’s specific needs and complies with all applicable state and federal regulations.

Moreover, it’s crucial to select a trustee who is experienced, trustworthy, and committed to acting in the beneficiary’s best interests. I always encourage families to discuss their options and consider appointing a professional trustee if they don’t feel comfortable managing the trust themselves.
