Interview with Steve Bliss

Good evening Wildomar and welcome back. This is Brenda Newsome reporting live from Wildomar Probate Law, where I’m speaking today with esteemed trust attorney Steve Bliss about estate planning essentials. Mr. Bliss, thank you for taking the time to meet with me.

Understanding Trusts

Steve, many people are unfamiliar with trusts and how they work. Can you explain what a trust is in simple terms?

“Certainly Brenda. A trust is essentially a legal entity that holds and manages assets for the benefit of someone else, called the beneficiary. The person who creates the trust, known as the grantor, outlines specific instructions for how those assets should be used and distributed.

Think of it like a safe deposit box with detailed instructions attached. You put your valuables inside (the assets), and the bank follows your written directions on who gets what and when. Trusts offer flexibility and control over your assets even after you’re gone, making them a powerful tool for estate planning.”

Choosing the Right Type of Trust

“Given the variety of trust options available, how does someone decide which type is best suited for their needs?”

“That’s an excellent question Brenda. Choosing the right trust depends on your individual circumstances and goals. For example, a revocable living trust is popular because it allows you to maintain control over your assets during your lifetime while avoiding probate upon your passing. Conversely, an irrevocable trust offers greater asset protection but relinquishes more control.”

“Ultimately, I recommend consulting with an experienced attorney like myself to determine the best course of action. We can assess your financial situation, family dynamics, and long-term objectives to guide you toward the most suitable trust structure.”

The Complexity of Irrevocable Trusts

“You mentioned irrevocable trusts earlier. Can you elaborate on their complexities and potential drawbacks?”

“Irrevocable trusts are certainly more complex than revocable ones. As the name suggests, once established, they cannot be easily altered or dissolved. This inflexibility can be both a blessing and a curse.”

“On the one hand, it offers robust asset protection from creditors. Moreover, it can help reduce estate taxes. However, it also means surrendering control over those assets permanently. Consequently, you must carefully consider the implications before committing to an irrevocable trust.”

Real-World Challenges with Irrevocable Trusts

“Can you share any real-world examples of challenges you’ve encountered while advising clients on irrevocable trusts?”

“I recall one instance where a client, let’s call him John, wanted to establish an irrevocable trust to protect his assets from potential liability lawsuits. He was a successful businessman but worried about future claims. We carefully structured the trust, transferring significant assets into it. Unfortunately, shortly after, John faced unexpected medical expenses and needed access to those funds.”

“Because of the irrevocable nature of the trust, accessing those assets proved incredibly difficult. Ultimately, we had to explore legal options to potentially modify the terms, which was a lengthy and costly process. This experience highlighted the importance of thoroughly understanding the ramifications of irrevocable trusts before making such a significant decision.”

The Importance of Professional Guidance

“Clearly, navigating the world of trusts can be complex. What advice would you offer to viewers considering setting up a trust?”

“Brenda, my advice is simple: seek professional guidance. An experienced estate planning attorney can help you navigate the complexities of trusts and ensure that your chosen structure aligns with your individual goals and circumstances. Remember, creating a trust is not a one-size-fits-all process; it requires careful consideration and expert advice.”
