“Probate is essentially a court-supervised process that validates a will and administers the estate of a deceased person,” Mr. Bliss explains. “It involves identifying and inventorying assets, paying debts and taxes, and ultimately distributing the remaining property to heirs or beneficiaries according to the will’s instructions or state law if there’s no will.”

“Not every estate requires probate. For example, if the total value of the deceased person’s assets is below a certain threshold ($184,500 in California) and they don’t have complex holdings like real estate, probate might be avoidable. Assets held in trusts or jointly owned property also typically bypass probate.”

Marshaling Estate Assets: A Crucial Step

“Today,” I ask, “we’re focusing on the step of marshaling estate assets. Can you walk us through what that entails?

“Certainly,” Mr. Bliss responds. “Marshaling assets is a critical stage in probate. It involves meticulously identifying and inventorying all of the deceased person’s assets – bank accounts, investments, real estate, vehicles, personal property, and even digital assets.”

“Once identified, these assets are appraised to determine their current market value. This information is then compiled into a formal document called an Inventory and Appraisal (Forms DE-160/161) which must be filed with the court.”

Mr. Bliss continues, “This step is crucial because it provides a clear picture of the estate’s financial standing, allowing for accurate debt repayment and fair distribution of assets to beneficiaries.” Consequently, it often requires careful research and attention to detail.

“Have you encountered any particular challenges during this stage of probate?” I inquire.

Mr Bliss leans forward thoughtfully. “One situation that sticks out involved a deceased individual who had numerous investment accounts scattered across different institutions. Tracking down all the accounts and obtaining necessary documentation was time-consuming but ultimately essential for ensuring a complete and accurate accounting of the estate’s assets.”

“Another instance involved locating heirs who were estranged from the deceased. We had to conduct extensive genealogical research, which eventually led us to uncover distant relatives who were entitled to a portion of the inheritance. Cases like these highlight the importance of thoroughness and persistence when marshaling estate assets.”
